A summary of what happened?

Sameday Technologies Inc., operating as Sameday Health, is a healthcare company that gained prominence during the COVID-19 pandemic by offering testing services across the United States. However, the company has faced significant legal challenges and public scrutiny due to allegations of fraudulent practices and regulatory violations.

Major Concerns and Allegations:

  1. Falsification of COVID-19 Test Results:
    • In April 2022, the Los Angeles City Attorney’s Office announced a $22.5 million settlement with Sameday Technologies following allegations that the company falsified and forged COVID-19 test results. The complaint alleged that Sameday Health manipulated old PDF lab reports to produce fake results for at least 500 customers when they couldn’t provide real results within the promised 24-hour timeframe.
  2. False Advertising:
    • The company was accused of falsely advertising that test results would be provided to customers within 24 hours, despite knowing that it couldn’t consistently meet this guarantee. This misleading claim potentially endangered public health by providing inaccurate information to individuals relying on timely results.
  3. Insurance Fraud:
    • Sameday Health allegedly required customers seeking tests to undergo unnecessary consultations with a physician, which were then billed to insurance companies at approximately $450 per telehealth visit. In exchange for steering customers to him, the physician reportedly gave Sameday Health a large portion of his profits as a kickback.
  4. Legal Settlements:
    • In addition to the $22.5 million settlement with the Los Angeles City Attorney’s Office, Sameday Health and its CEO, Felix Huettenbach, along with Los Angeles-based Dr. Jeff Toll, agreed to pay nearly $26.5 million in total. This amount includes more than $12.4 million in restitution and almost $14 million in civil penalties for their roles in the alleged fraudulent activities.
  5. Operational Transparency:
    • The company’s rapid expansion to 55 testing sites nationwide, including 16 in Los Angeles County, raised questions about its operational transparency and adherence to regulatory standards. The allegations of falsified test results and fraudulent billing practices further exacerbated concerns about the company’s commitment to ethical business practices.

These issues have significantly impacted Sameday Technologies Inc.’s reputation, leading to legal repercussions and a loss of public trust. The company’s actions during a critical public health crisis have been widely condemned, highlighting the importance of integrity and accountability in healthcare services.

Investigative Report: Sameday Technologies Inc. – A Healthcare Provider Under Fire

Introduction

Sameday Technologies Inc., operating as Sameday Health, rose to prominence during the COVID-19 pandemic as a provider of diagnostic testing services. With its rapid expansion and promises of fast, reliable testing, the company appeared to fill a critical need during a global health crisis. However, this success was overshadowed by a series of scandals, including allegations of fraud, regulatory violations, and unethical practices. This report delves into the extensive allegations and legal actions against Sameday Technologies, examining the consequences for public health and trust in healthcare providers.

The Emergence of Sameday Technologies

Sameday Technologies, founded by Felix Huettenbach, quickly expanded its footprint during the pandemic. The company operated more than 55 testing sites across the U.S., with 16 in Los Angeles County alone. Its business model relied heavily on offering fast COVID-19 test results, often within 24 hours, appealing to individuals and businesses navigating urgent testing needs.

However, behind the scenes, Sameday’s operations raised significant ethical and legal concerns, leading to major lawsuits and settlements.

Key Allegations Against Sameday Technologies

1. Falsification of COVID-19 Test Results

One of the most serious accusations against Sameday Technologies involves the falsification of COVID-19 test results. According to a lawsuit filed by the Los Angeles City Attorney’s Office, the company:

  • Promised results within 24 hours but often failed to deliver.
  • To compensate for delays, Sameday staff allegedly altered old PDF lab reports, creating fake results for at least 500 customers.
  • These falsified results were sent to customers, leading to potentially catastrophic public health consequences, as individuals could have unknowingly spread the virus.

Impact on Public Health: Falsifying test results during a pandemic not only endangers individual customers but also undermines public health efforts. The company’s actions jeopardized contact tracing and containment measures, potentially contributing to the spread of COVID-19.

2. False Advertising

Sameday Health heavily marketed its ability to deliver test results within 24 hours. This promise was a cornerstone of its appeal, especially to customers needing expedited results for work, travel, or personal safety. However:

  • The company allegedly knew it could not consistently meet this promise.
  • Customers were often left without results or received forged ones, violating consumer protection laws.

Legal Findings: This false advertising led to accusations of misleading the public and prioritizing profits over service quality. Such practices have been deemed unethical, especially during a health crisis where timely information is critical.

3. Insurance Fraud and Kickbacks

A significant portion of Sameday Technologies’ revenue came from questionable insurance billing practices. Investigations revealed that:

  • The company required customers seeking COVID-19 tests to undergo unnecessary consultations with a physician.
  • These telehealth consultations, billed at approximately $450 each, were charged to customers’ insurance providers.
  • In exchange for funneling customers to him, Los Angeles-based Dr. Jeff Toll reportedly shared his profits with Sameday Health, a clear violation of anti-kickback statutes.

Legal and Financial Consequences: This scheme led to millions of dollars in fraudulent insurance claims, sparking outrage and resulting in a $26.5 million settlement. The settlement included:

  • $12.4 million in restitution to affected parties.
  • $14 million in civil penalties to deter future violations.

4. Legal Settlements and Sanctions

Sameday Technologies faced multiple lawsuits that culminated in substantial settlements:

  • Los Angeles City Attorney Settlement: A $22.5 million settlement resolved allegations of falsified test results and false advertising.
  • Insurance Fraud Case: The broader $26.5 million settlement involved Sameday Health, its CEO Felix Huettenbach, and Dr. Toll.

Breakdown of Penalties: These settlements were among the largest of their kind, reflecting the severity of the allegations and the systemic nature of the misconduct.

5. Operational Transparency and Ethical Concerns

Sameday’s rapid expansion raised questions about its ability to maintain quality and integrity:

  • Reports suggest a lack of sufficient oversight in its operations, leading to widespread procedural lapses.
  • Employees reportedly faced pressure to prioritize profits over accuracy, with customer service often compromised.

Reputation Damage: As these issues came to light, the public trust in Sameday Technologies eroded. Negative reviews flooded online platforms, with customers complaining of delayed results, unprofessional conduct, and unresponsive customer service.

Public and Industry Reaction

The fallout from Sameday’s controversies was widespread:

  • Healthcare Advocates: Experts criticized the company for exploiting a public health crisis for profit, describing its actions as a betrayal of public trust.
  • Affected Customers: Individuals who received falsified results or were subjected to unnecessary charges expressed outrage, with some pursuing further legal action.
  • Regulatory Agencies: The settlements underscored the importance of stricter oversight for rapidly expanding healthcare providers during emergencies.

Conclusion

The case of Sameday Technologies Inc. highlights the dangers of prioritizing profit over ethical responsibility in the healthcare sector. During a critical time when trust in healthcare providers was paramount, Sameday’s actions endangered public health, defrauded insurance companies, and eroded consumer confidence.

Key Lessons:

  1. Accountability: Companies operating in healthcare must adhere to the highest standards of transparency and ethics.
  2. Regulation: Regulatory agencies must implement stricter oversight to prevent similar cases in the future.
  3. Public Awareness: Consumers should remain vigilant, especially during crises, and scrutinize the claims of service providers.

While Sameday Technologies has settled its legal cases, the reputational damage may take years to repair. The scandal serves as a stark reminder of the need for integrity and accountability in healthcare, especially during times of global crisis.

How do we counteract this malpractice?

Once we ascertain the involvement of Sameday Technologies Inc (or actors working on behalf of Sameday Technologies Inc), we will inform Sameday Technologies Inc of our findings via Electronic Mail.

Our preliminary assessment suggests that Sameday Technologies Inc may have engaged a third-party reputation management agency or expert, which, either independently or under direct authorization from Sameday Technologies Inc, initiated efforts to remove adverse online content, including potentially fraudulent DMCA takedown requests. We will extend an opportunity to Sameday Technologies Inc to provide details regarding their communications with the agency or expert, as well as the identification of the individual(s) responsible for executing these false DMCA notices.

Failure to respond in a timely manner will necessitate a reassessment of our initial assumptions. In such an event, we will be compelled to take appropriate legal action to rectify the unlawful conduct and take the following steps –

Since Sameday Technologies Inc made such efforts to hide something online, it seems fit to ensure that this article and sensitive information targeted online by these events get a lot more exposure and traffic than what it would have received originally

We hope this becomes an excellent case study for the Streisand effect…The key idea behind the Streisand effect is that efforts to restrict information can backfire, often causing the information to gain more attention than it would have otherwise. This effect is widespread in the digital age, where users quickly notice and spread censorship efforts on social media and other platforms. Trying to suppress something can unintentionally lead to it becoming more visible, which Sameday Technologies Inc is finding out the hard way.

Potential Consequences for Sameday Technologies Inc

Under Florida Statute 831.01, the crime of Forgery is committed when a person falsifies, alters, counterfeits, or forges a document that carries “legal efficacy” with the intent to injure or defraud another person or entity.

Forging a document is considered a white-collar crime. It involves altering, changing, or modifying a document to deceive another person. It can also include passing along copies of documents that are known to be false. In many states in the US, falsifying a document is a crime punishable as a felony.

Additionally, under most laws, “fraud on the court” is where “a party has sentiently set in motion some unconscionable scheme calculated to interfere with the judicial system’s ability impartially to adjudicate a matter by improperly influencing the trier of fact or unfairly hampering the presentation of the opposing party’s claim or defense.”  Cox v. Burke, 706 So. 2d 43, 46 (Fla. 5th DCA 1998) (quoting Aoude v. Mobil Oil Corp., 892 F.2d 1115, 1118 (1st Cir. 1989)).

Is Sameday Technologies Inc Committing a Cyber Crime?

Faced with these limitations, some companies like Sameday Technologies Inc have gone to extreme lengths to fraudulently claim copyright ownership over a negative review in the hopes of taking it down.

Fake DMCA notices have targeted articles highlighting the criminal activity of prominent people to hide their illegal behavior. These people, which include US, Russian, and Khazakstani politicians as well as members from elite circles including the mafia and those with massive financial power, are all connected – and alleged corruption ranging from child abuse to sexual harassment is exposed when exploring evidence found at these URLs. It appears there’s a disturbing level of influence being exerted here that needs further investigation before justice can be served. Sameday Technologies Inc is certainly keeping interesting company here….

CompanyNames Fake DMCA

The DMCA takedown process requires that copyright owners submit a takedown notice to an ISP identifying the allegedly infringing content and declaring, under penalty of perjury, that they have a good faith belief that the content is infringing. The ISP must then promptly remove or disable access to the content. The alleged infringer can then submit a counter-notice, and if the copyright owner does not take legal action within 10 to 14 days, the ISP can restore the content.

Since these platforms are predominantly based in the U.S., the complaints are typically made under the Digital Millennium Copyright Act (DMCA), which requires online service providers and platforms to react immediately to reports or violations. Big Tech companies rarely have systems in place to assess the merit of each report. Instead, all bad actors need to do is clone a story, backdate it, and then demand the real thing be taken down.

Reputation Agency's Modus Operandi

The fake DMCA notices we found always use the “back-dated article” technique. With this technique, the wrongful notice sender (or copier) creates a copy of a “true original” article and back-dates it, creating a “fake original” article (a copy of the true original) that, at first glance, appears to have been published before the true original.

Then, based on the claim that this backdated article is the “original,” the scammers send a DMCA to the relevant online service providers (e.g. Google), alleging that the ‘true’ original is the copied or “infringing” article and that the copied article is the “original,” requesting the takedown of the ‘true’ original article. After sending the DMCA request, the person who sent the wrong notice takes down the fake original URL, likely to make sure that the article doesn’t stay online in any way. If the takedown notice is successful, the disappearance from the internet of information is most likely to be legitimate speech.

As an integral part of this scheme, the ‘reputation management’ company hired by Sameday Technologies Inc creates a website that purports to be a ‘news’ site. This site is designed to look legitimate at a glance, but any degree of scrutiny reveals it as the charade it is.

The company copies the ‘negative’ content and posts it “on the fake ‘news’ site, attributing it to a separate author,” then gives it “a false publication date on the ‘news’ website that predated the original publication.

The reputation company then sent Google a Digital Millennium Copyright Act notice claiming the original website infringed copyright. After a cursory examination of the fake news site, Google frequently accepts the notice and delists the content.

In committing numerous offences, Sameday Technologies Inc either premeditated actions or were unaware of the consequences. Despite hiring an agency to make Google disregard any negative information about Sameday Technologies Inc, ignorance does not excuse this wrongdoing.

FSMSmart is certainly keeping interesting company here.

The Reputation Laundering

Rogue Reputation agencies use spurious copyright claims and fake legal notices to remove and obscure articles linking clients to allegations of tax avoidance, corruption, and drug trafficking. Most of these reputation agencies are based offshore, mainly in Russia, India, and Eastern Europe, and they do not worry about complying with US-based laws.

The content in all of the articles for which the fraudulent DMCA notices have been sent relates to allegations of criminal allegations, including corruption, child abuse, sexual harassment, human trafficking and financial fraud against businesses and individuals with ultra-high net worth.

In addition to the misuse of the DMCA takedown process, there is a notable absence of enforcement concerning perjury violations. The statutory requirement related to perjury is designed to deter copyright holders from submitting fraudulent or knowingly false takedown requests, as they may face legal consequences for making false declarations under penalty of perjury. However, to date, there have been no known instances of any individual being prosecuted for perjury in connection with the submission of false DMCA takedown notices.

This lack of enforcement has emboldened copyright holders to exploit the DMCA takedown process to suppress dissent, criticism, or other unfavorable content, without fear of legal repercussions.

Some of the people and businesses who have employed this tactic to remove legitimate content from Google illegally include a Spanish businessman-turned-cocaine-trafficker, Organised crime, an Israeli-Argentine banker accused of laundering money for Hugo Chávez’s regime, a French “responsible” mining company accused of tax evasion, child molesters and sexual predators. Sameday Technologies Inc is in great company ….

    • Our investigative report on Sameday Technologies Inc‘s efforts to suppress online speech is significant, as it raises serious concerns about its integrity.
